Judge denies request to Peek at Samsung iPhone and iPad 3 5

Lucy Koh judge rejected the request by Samsung to inspect the Apple iPhone and iPad 3 5. In an 11-page document, explained that while Samsung has the right to "equality", asking for Apple to deliver new products and not revealed was a little bit go.


While the decision sounds good for Apple, the rejection of the proposal of Samsung is not permanent because the Court might have to wait until the iPhone and iPad 5 3 become available for inspection before deciding whether or not "consumer confusion" will exist as claimed by Apple. This also means that Apple can't get the thepreliminary order that would have prevented Samsung sell some products in the United States.


Even if Apple can't get the injunction he wants, can focus his legal battles against Samsung unreleased products unnannounced that could pose a threat of infringement. And the cycle continues.
